Terms and Conditions

Introduction

This agreement dictates the use of services, digital products and physical products of Eventlasting, which extends to rent, licensing, subscription and purchases of all audio and digital content. These products and services are non-transferable, unalterable and available to you after purchase/rent/license/subscription and to be consumed with appropriate hardware, software or internet access which may in turn impact the performance of the product or service. Hereunder, ‘you’ are referred to as the individual that is a user of the products and services of New Repertoire, or if you are acting on the behalf of a business, you and the entity will be considered as a whole. ‘We/us/Eventlasting’ refers to New Repertoire Pty Ltd ATF Lee’s Trust. By proceeding with the use of our product or service, you agree to be bound by the terms and conditions comprised herein.

Terms of Service

Eventlasting is entitled to the modification or discontinuation of services or products anytime and may do so without notice to you. The same applies to the terms of service. Accordingly, it is your obligation to regularly examine any changes that occur. All components of our products and services, including but not limited to graphics, text, audio and video must not be redistributed, sold or copied.

With regards to payments and receipts, you will be held accountable for the security of your credit card or other payment method that is charged. At the same time, Eventlasting is not responsible for errors or acts by you that are related to the payment. We have the authority to charge your payment account provided by you for what you have bought. In addition, you are solely responsible for keeping and maintaining your receipts from Eventlasting.

Should any product or service be defective, you have the right to ask for a replacement from Eventlasting. You agree to buy and use our products and services in compliance with Australian law. We are not liable for any technical or other issues that do not form the product itself.

Limitation of Liability

Eventlasting makes no warranties, claims or representations that the products and services will be uninterrupted or free of error, on which we disclaim any such guarantee. You accept that the products and services may not always be available to you or changed, and your use of the products or services may be suspended should it be reasonably in our interest to act thus. You also accept that any risk like malware or virus, should it ever happen during the downloading or consumption of the products or services, be purely your responsibility. In no way will Eventlasting be liable for loss or damage from use of the product or service, including that of a third party as according to the laws on liability limitation of your jurisdiction.

Ownership of Intellectual Rights

You accept that New Repertoire Pty Ltd is the rightful owner of all products and services’ trademarks, content, copyrights, and other intellectual property rights both registered and unregistered. You further accept that the aforementioned intellectual property will not be altered, sold, loaned or distributed.

Termination and Other Provisions

If the agreement’s provisions have been infringed or you have been fairly suspected of doing so, Eventlasting has the right to suspend and discontinue the products and services to you without liability to you or any third party.

Eventlasting also has the right to enforce your abidance with the agreement and validate your use of the products and services. The user or buyer agrees to the terms and conditions thus outlined and will depend on them as the only representation of the terms of this agreement.
